General Terms and Conditions (AGB)

Contractual partner

A contract is concluded between the customer and B & H Lübeck GmbH (address: Brockesstr. 65 – 23554 Lübeck, Lübeck Local Court: HRB 10446 HL), hereinafter referred to as the provider, on the basis of these General Terms and Conditions (GTC).

Subject matter of the contract

This contract governs the sale of services via the provider’s online presence. For details of the respective offer, please refer to the product description on the offer page.

Conclusion of contract, contract design and contract duration

The contract is concluded in electronic business transactions via the online system or via other means of remote communication such as telephone and e-mail. The offers presented represent a non-binding invitation to submit an offer through the customer order, which the provider can then accept. The order process for concluding the contract comprises the following steps in the online system:
Press the “BOOK NOW” button or the “Booking” menu item
Selection of the desired date and room
Specification of the participating persons
Entering contact details
Acceptance of the GTCs
Press the “Next” button
Confirmation email that the order has been received.
The customer has no possibility of directly accessing the stored contract text.

The contract is concluded for an indefinite period.

Prices

All prices are final prices and include statutory VAT.

Resale

The commercial resale of tickets for an event of the provider by unauthorized third parties is prohibited without the written consent of the provider.

Terms of payment

The customer only has the following options for payment: payment service provider (PayPal), bank transfer, cash payment on site and for corporate customers on account. Other payment methods are not offered and will be rejected. If a payment service provider is used, this enables the provider and customer to process the payment between themselves. The payment service provider forwards the customer’s payment to the provider. Further information can be found on the website of the respective payment service provider. The invoice amount can also be paid in cash at the provider’s business premises during normal opening hours.

Right of withdrawal

The provider sells services in the field of leisure activities. These are excluded from reimbursement and exchange in accordance with § 312 g paragraph 2 no. 9 BGB. This means that there is no right of withdrawal with regard to tickets purchased via the online presence.

Liability of the customer

Participation in the game is at your own risk. The customer is liable for all damage caused by him on the provider’s premises. The customer shall be invoiced for the repair payments or the costs of replacement.

Receipt of e-mails

The customer agrees to receive e-mails sent to confirm the online ticketing or online reservation. Consent also includes a one-off email to the customer asking them to rate the game after attending the event.

Behavior of the customer, expulsion

The rooms of the provider are subject to § 2 of the Copyright Act, therefore it is strictly forbidden to film and photograph in all rooms. Smoking is strictly prohibited in all rooms of the provider. The provider reserves the right to prohibit access to persons who are under the influence of alcohol or drugs or who display conspicuously aggressive behavior. No animals may be brought to the event.

Language, place of jurisdiction, applicable law and severability clause

The contract is drawn up in German. The further implementation of the contractual relationship shall be in German. The law of the Federal Republic of Germany shall apply exclusively. This only applies to consumers insofar as it does not restrict any statutory provisions of the country in which the customer is domiciled or habitually resident. The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law or special funds under public law is the registered office of the provider. The invalidity of any provision of these GTC shall not affect the validity of the remaining provisions.
